Define: "engage in insurance"?

Does this mean someone who sells insurance or does it include the guy who sweeps up the insurance offices too?
Interesting question!! Particularly with respect to the issue of hiring someone to "engage in the insurance trade" who's been convicted of a felony, it's specifically NOT defined, so it CAN include the guy who sweeps the office, along with the agent selling insurance, AND the guy washing windows.

If someone convicted of a felony wants to sweep the office, tecnhically he has to have the written permission of the state insurance commissioner to do so as an employee of the agency or company.

Of course, this is not policed in the real world.
My state's law provides the following definition:

"(1) "Insurance business" includes the transaction of:

(i) all matters pertaining to an insurance contract, either before or after it takes effect; and
(ii) all matters arising from an insurance contract or a claim under it.

(2) "Insurance business" does not include pooling by public entities for self-insurance of casualty, property, or health risks."

So person one in your inquiry engages in the business of insurance; person two does not, since he or she is not engaged in any transactions pertaining to a contract.
