The Southeast Underwriters Association, insurance has be under the Commerce clause of the Constitution and and so under the jurisdiction of Congress. However, surrounded by the McCarrin-Ferguson act, Congress delegate that responsiblity to the States, so insurance is generally beneath state regulation. I don't really know what the "Insurance Act" is.
