They may well be.
Falling trees (not flooring) are considered an act of God in US insurance contracts and are covered by the damaged parties insurance, not who owns the tree.

What country are you in?
In the UK a neighbour has the right to cut any branches that overhang their property but you still own it so you can insist they hand any branches to you should you want them.
Bedmechanic's answer is correct in much of the US as well. I'm not sure if that is your question either.
