What do you mean ... does it have to be 'filed'. A good faith effort has to be made to notify the employoee about their COBRA rights, but if the EE didn't notify the company of a new address, the company cannot be a mind reader. If the EE gets in touch with the company within the time limit (under 60 days), then a new package can be sent.

The COBRA law is very exact and complicated ... most companies outsource the funciton to COBRA experts. They know the rules inside and out.
