Health insurance fraud?
My question is if a couple is divorced ..it has been almost a year. He is federally employed. He never took her off his insurance and she has been using it since the divorce. Isn't this insurance fraud because the insurance company still thinks they are married?
No, its not fraud... If there's any recourse available its through the employer. They're allowing her to stay covered. Surely, they noticed he got a divorce. Maybe the cover they, simply because he asked... Its not uncommon. If he's paying the premium out of his check, the insurance company won't be able to do anything about it.
no in some cases like in divorces it is mandatory that the man still carries insurance for the women for a certain amount of time and vice versa. Besides he may have it set up maybe she is paying for half of it too and through the insurance company
Answers:
It is not insurance fraud. It is up to him to provide his employer with the change in status. Since it's been over a year since the divorce, he will probably have to wait until the next open enrollment to take her off the policy.
Until then, she's still on the insurance, and there isn't anything that can be done about it. He should have reported it to his employer the minute the divorce was final.
Yes it would be fraud. He is having a benefit extended to a person that is not eligible because he is not telling the truth. I would report it. As a government employee it is costing all of us money
Depends on the divorce settlement.
